14. DISPUTE RESOLUTION

14.1 Binding Arbitration

The arbitration shall be held in the county of the customer's billing address, or at another mutually agreed location. If the claim does not exceed $10,000, the arbitration may be conducted by telephone or based solely on written submissions.

14.3 No Class Actions

YOU AND ZUUKANA STORES AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

14.4 Small Claims Court

Notwithstanding the foregoing, either party may bring an individual action in small claims court if the claim is within that court's jurisdiction and is brought on an individual basis.

14.5 Governing Law

These Terms and any Disputes shall be governed by the laws of Kenya, without regard to its conflict of laws principles.

15. SEVERABILITY

If any provision of these Terms is held to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

16. WAIVER

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

17. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time by posting the revised Terms on our Site. The most current version will always be posted on this page, and the "Last Updated" date at the top will reflect the effective date of the changes. By continuing to access or use our Site after any revisions become effective, you agree to be bound by the revised Terms.

18. ENTIRE AGREEMENT
